Question: Help progressive Won’t Pay!?

Massachusetts law states…

From the Mass.gov website:
“6) AN OBJECT DAMAGED MY WINDSHIELD AND I AM UNABLE TO DETERMINE WHERE IT CAME FROM. AM I COVERED FOR THIS LOSS?

Yes, if you have comprehensive insurance you are covered for the full amount of the loss, unless you opted for a $100 deductible for glass breakage. The $300, $500, or $1000 deductible, or whatever you may have selected for comprehensive coverage, does not apply to a glass loss.”

However Progressive refuses to pay for the glass damage to my vehicle. I believe they are not following the law. They claim my $1000.00 deductible still applies, however MA law states that these deductibles to not apply.

What should I do?
I did select the 1,000 glass deductible however the MA law clearly states these deductibles do not apply.
Yes only the glass needs to be repaired or replaced. The wind shield more specifically. Nothing else.

Answer: In my state (not MA) – we also waive deductibles for glass only damage.

That means glass only damage. If anything other than glass is repaired or replaced, the deductible applies. So….if the object flys up and chips thepaint on the hood on it’s way to hitting the glass and you claim the damage to your hood- the deductible applies.

So….is the ONLY thing being repaired/replaced glass?

If the information you and other posters provided – it looks like you had the option of selecting comp w/o a glass deductible. However, in exchange for a lower premium you chose a 1000 glass deductible.

You may want to follow up with your agent or the insurance department for your state. But odds are….you are s.o.l.
